Terms of Service & SMS Terms

1. Acceptance of These Terms
These Terms of Service ("Terms") are a binding agreement between you and Mabel ("Mabel," "we," "us," or "our") governing your access to and use of the Mabel website, SMS/text-message service, and related services (collectively, the "Service"). By subscribing to, texting, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What the Service Is — and Is Not
Mabel is a text-message-based assistant that provides plain-language explanations of documents, letters, bills, and messages that users submit, and identifies common characteristics associated with fraud or scams.
The Service is NOT:
- Professional advice of any kind. The Service does not provide legal, medical, financial, investment, tax, insurance, or accounting advice, and no output of the Service should be treated as such. Always consult a qualified, licensed professional before making decisions in these areas.
- A fraud-prevention, fraud-detection, or security product. The Service does not block, filter, intercept, or monitor calls, texts, mail, or transactions. It offers educational observations about content you choose to send us.
- A guarantee of accuracy. Responses are generated with the assistance of artificial intelligence and may be incomplete, outdated, or incorrect. See Section 6.
- An emergency service. If you believe you are the victim of fraud or a crime, or that money is at risk right now, contact your bank, the relevant institution using a phone number you independently verify, and/or law enforcement immediately. Do not rely on the Service in an emergency.
3. No Reliance; Your Responsibility for Decisions
You acknowledge and agree that: (a) the Service provides general information to help you form your own judgment; (b) you will independently verify any important information before acting on it; (c) any decision to respond to, pay, sign, call, click, ignore, or otherwise act on any document or message — or not to act — is solely yours; and (d) Mabel is not responsible for the outcome of those decisions, including any financial loss. A response from the Service indicating that a message does not display common scam characteristics is not a representation that the message is safe, legitimate, or trustworthy.
4. Eligibility; Enrolling Another Person
You must be at least 18 years old to purchase a subscription. If you enroll a mobile number belonging to another person (for example, a parent), you represent and warrant that you have that person's knowledge and consent, that you are authorized to enroll them, and that you will remain responsible for the subscription. The enrolled user may stop messages at any time by replying STOP.
5. SMS Program Terms
- Program description: Mabel sends recurring informational text messages in response to documents and questions submitted by the user, plus limited service messages (welcome, help, billing, and service notices).
- Message frequency: Varies based on your use of the Service.
- Cost: Message and data rates may apply and are charged by your mobile carrier. The subscription fee is separate and described in Section 7.
- Opt-out: Reply STOP to any message to stop receiving texts. You may receive one final message confirming your opt-out.
- Help: Reply HELP to any message or email support@textmabel.com.
- Carriers: Carriers are not liable for delayed or undelivered messages. The Service may not be available on all carriers or in all regions.
- Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
6. AI-Generated Content Disclaimer
Responses are generated using artificial intelligence technology. AI-generated content can contain errors, omissions, or statements that appear confident but are wrong. Mabel does not review each response before it is sent. You agree that you understand these limitations and will treat every response as a helpful starting point for your own judgment — never as a definitive determination of fact, legitimacy, or safety.
7. Subscriptions, Billing, and Cancellation
- The Service is offered as a recurring monthly subscription at the price shown at checkout, billed in advance through our payment processor (Stripe). We do not store your full payment card details.
- Your subscription renews automatically each month until cancelled.
- You may cancel at any time via the management link in your Stripe receipt email or by emailing support@textmabel.com. Cancellation takes effect at the end of the current billing period. Replying STOP halts text messages but you must also cancel billing as described above.
- Except where required by law, payments are non-refundable; however, we may issue refunds or credits at our sole discretion.
- We may change subscription pricing with at least 30 days' advance notice; continued use after the change takes effect constitutes acceptance.
8. Acceptable Use
You agree not to use the Service to: (a) submit content you do not have the right to share; (b) request assistance with unlawful activity; (c) harass, abuse, or harm others; (d) probe, disrupt, reverse-engineer, or overburden the Service; (e) resell or provide the Service to third parties as your own offering; or (f) submit another person's sensitive personal information without their authorization. We may suspend or terminate accounts that violate this section.
9. Privacy and Submitted Content
Our collection and use of information is described in the Privacy Policy. You retain ownership of the content you submit. You grant Mabel a limited license to process, store, and transmit submitted content solely to operate, secure, and improve the Service. Please avoid sending full account numbers, Social Security numbers, or passwords — the Service does not need them to explain a document.
10. Intellectual Property
The Service, including its name, branding, website, and content (excluding content you submit), is owned by Mabel and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
11. Third-Party Services
The Service relies on third-party providers, including telecommunications carriers, messaging providers, AI model providers, and payment processors. We are not responsible for the acts, omissions, outages, or policies of third parties, and your use of their services may be subject to their own terms.
12. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade. Mabel does not warrant that the Service will be uninterrupted, timely, secure, or error-free; that responses will be accurate, complete, or reliable; or that the Service will identify any or all fraudulent, deceptive, or harmful content.
13. Limitation of Liability
To the maximum extent permitted by law: (a) in no event will Mabel, its owner(s), employees, contractors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of money, profits, savings, data, or goodwill, arising out of or related to the Service or these Terms — including, without limitation, losses resulting from fraud, scams, identity theft, or reliance on any response from the Service — even if advised of the possibility of such damages; and (b) Mabel's total cumulative liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of fifty dollars (US $50) or the amount you paid to Mabel in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In those jurisdictions, liability is limited to the fullest extent permitted by law.
14. Indemnification
You agree to defend, indemnify, and hold harmless Mabel and its owner(s), employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) content you submit; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party; or (e) enrolling a mobile number without proper authorization.
15. Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this section carefully — it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be conducted in the county where you reside or remotely by videoconference.
You and Mabel each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or other representative proceeding. Disputes may be brought only on an individual basis.
Before filing arbitration, the party asserting a dispute must first send written notice to the other (for Mabel, at support@textmabel.com) describing the dispute, and the parties will attempt in good faith to resolve it within 30 days. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out."
16. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 15. Subject to Section 15, any claims not subject to arbitration must be brought exclusively in the state or federal courts located in Marion County, Indiana.
17. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, suspected abuse, legal risk, or discontinuation of the Service, with a pro-rata refund of prepaid fees where termination is not for cause. Sections 3, 6, and 9–19 survive termination.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by text message and/or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
19. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary. These Terms, together with the Privacy Policy, are the entire agreement between you and Mabel regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
